These terms govern use of the Vivify Custom Remodeling website. Project-specific proposals and signed agreements contain the actual scope, price, schedule, warranties, and obligations for remodeling work.

Important project notice

Website content, examples, calculators, promotions, and preliminary conversations are for general information only. They are not a binding construction contract, final estimate, professional design document, permit approval, warranty, or promise of project availability. A project begins only under a written agreement signed by the appropriate parties.

1. Agreement to these terms

By accessing this website, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the site. “Vivify,” “we,” “us,” and “our” refer to Vivify Custom Remodeling Inc.

2. Website information

We aim to keep information useful and current, but remodeling conditions, materials, labor availability, building requirements, market pricing, and third-party programs can change. Photos may show prior projects, design concepts, or representative materials. Results vary by property, scope, selections, jurisdiction, and site conditions.

3. Estimates, consultations, and project agreements

  • A website request or consultation does not require either party to proceed.
  • Preliminary ranges and calculator outputs are illustrative and may omit design, engineering, permits, demolition, remediation, site conditions, taxes, delivery, upgrades, or change orders.
  • Final scope, pricing, deposits, payment milestones, schedule, cancellation rights, warranties, and dispute terms are governed by a signed project agreement and applicable law.
  • If these website terms conflict with a signed project agreement, the signed project agreement controls for that project.

4. Promotions and complimentary design offers

Any promotion, discount, free estimate, or complimentary 3D design offer is subject to stated eligibility, service area, project type, consultation requirements, availability, and written offer terms. Unless a signed agreement says otherwise, a complimentary design is a planning or visualization aid and is not a complete set of architectural, engineering, permit, or construction documents. Promotions may not be combined unless expressly stated.

5. Financing information

Financing is offered, if available, by independent third-party lenders and is subject to application, credit approval, lender terms, project eligibility, and applicable law. Vivify does not guarantee approval, rates, payment amounts, or funding. Any sample monthly payment or financing example is illustrative; review the lender’s disclosures before accepting financing.

6. Communications

When you provide contact information, you authorize us and our service providers to respond about your inquiry through the channels you provide. Consent to receive marketing communications is not a condition of purchasing services where prohibited by law. You may opt out of marketing emails using the unsubscribe method provided and may request that marketing calls or texts stop. Service-related communications may still be necessary for an active inquiry or project.

7. Acceptable use

You may use this site only for lawful, personal, and legitimate business purposes. You may not interfere with site operation; attempt unauthorized access; introduce malicious code; scrape or copy the site at scale; impersonate another person; submit false, abusive, or unlawful material; or use site content in a way that infringes another party’s rights.

8. Intellectual property

The site’s text, graphics, branding, layout, photographs, videos, and other content are owned by Vivify or used with permission and are protected by applicable intellectual-property laws. You may view and print reasonable excerpts for personal evaluation of our services. No other license is granted without written permission.

9. Third-party services and links

The site may link to lenders, scheduling tools, social networks, suppliers, manufacturers, or other third parties. We do not control their content, availability, terms, or privacy practices. A link does not necessarily mean endorsement. Your use of a third-party service is governed by that provider’s terms.

10. Website availability and disclaimers

To the extent permitted by law, the website is provided “as is” and “as available.” We do not warrant that the site will be uninterrupted, error-free, secure, or suitable for every purpose. Nothing in these terms excludes warranties or rights that cannot legally be excluded. This section concerns the website; warranties for contracted remodeling work are addressed in the applicable project agreement and law.

11. Limitation of liability

To the extent permitted by law, Vivify and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, this website. Any liability that cannot legally be excluded remains subject to applicable law. These limitations do not alter rights or remedies in a signed project agreement.

12. Governing law

These website terms are governed by California law, without regard to conflict-of-law rules. Any court proceeding concerning only these website terms will be brought in a court with proper jurisdiction in California, unless applicable law requires otherwise. Project disputes are governed by the applicable signed project agreement and law.

13. Changes and severability

We may update these terms as the site or legal requirements change. The effective date identifies the latest version. If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
